Why Tax Residency Matters for Indians Abroad

Residential status can influence how an individual’s income is considered under Indian tax rules and which compliance requirements may apply.

For an Indian living overseas, relevant questions can include:

  • What is the individual’s residential status in India for the relevant tax year?
  • Which income has an Indian source?
  • What income arises in the country where the individual lives?
  • Does the other jurisdiction also consider the individual a tax resident?
  • Is an applicable tax treaty relevant?
  • Are foreign taxes relevant to the individual’s Indian tax position?
  • Are additional reporting requirements applicable?

The answers depend on the individual’s circumstances, the jurisdictions involved, the nature and source of income and the rules applicable for the relevant tax year.

India’s Tax-Year Framework for Residential Status

For tax years beginning on or after April 1, 2026, residential status is governed by the Income Tax Act, 2025. Tax years beginning before April 1, 2026 continue to be governed by the Income-tax Act, 1961. The Income Tax Department states that residential status is assessed separately for each relevant tax year.

This distinction is relevant for individuals whose time spent in India changes from year to year. Their residential status should therefore be evaluated using the rules applicable to the specific tax year rather than assumed solely from their current country of residence.

When Tax Residency Involves More Than One Country

An individual can potentially be considered resident under the domestic rules of more than one jurisdiction. Where an applicable tax treaty exists, treaty provisions may address situations involving residence in both countries.

The specific rules depend on the countries involved and the individual’s circumstances. Indians living in the United States, United Kingdom, Canada, Australia, Singapore, Germany, the UAE and other jurisdictions may therefore need to consider both Indian tax rules and the rules applicable in their country of residence.

For example, the United States uses specific tests, including the green card test and substantial presence test, when determining whether certain individuals are treated as U.S. residents for tax purposes. The applicable rules contain specific conditions and exceptions.

This means an individual’s overall cross-border tax position may require consideration of more than one country’s domestic rules and, where applicable, the relevant tax treaty.

What NRIs Should Review Before Filing Taxes

Taxpayers with India-related financial interests should maintain records that can help establish their position for the relevant tax year.

Depending on their circumstances, these may include:

  • Dates of travel to and from India.
  • Information relevant to residential status.
  • Indian income records and supporting documents.
  • Property and investment transaction records.
  • Tax deducted or paid in India.
  • Relevant foreign tax information.
  • Tax-residency documentation from another jurisdiction, where applicable.
  • Documents relevant to an applicable tax treaty.

The exact documentation and reporting requirements depend on the individual’s circumstances and the jurisdictions involved.
