From digital arrest and fake investment platforms to UPI fraud, mule accounts and bank-account freezes, understanding the first legal steps can help victims and genuine account holders respond more effectively.

By Adv. Javed Pashu Sayyed, Advocate & Legal Professional

How Cyber Fraud Is Being Carried Out

Cybercrime in India is changing rapidly. Online fraud is no longer limited to stolen passwords or hacked email accounts. Fraudsters are increasingly using social engineering, fake investment platforms, impersonation, UPI transactions, phishing links, remote-access applications and so-called “digital arrest” threats to target individuals and businesses.

At the same time, cybercrime investigations can create another legal problem: a genuine person or business may find that its bank account has been placed under a lien, debit restriction or freeze because money connected with an alleged cyber fraud passed through the account.

Digital Arrest Scams

Fraudsters may impersonate police officers, CBI officials, customs authorities, telecom officials or other government representatives. A victim may be told that a parcel containing illegal material has been linked to their identity, that an Aadhaar or mobile number has been misused, or that a bank account is connected with money laundering.

The victim may then be threatened with arrest and instructed to remain connected through a video call before being asked to transfer money to a so-called safe or verification account. “Digital arrest” is a fraud technique, not a substitute for lawful arrest procedure.

Fake Investment and Trading Platforms

Victims may be approached through WhatsApp or Telegram groups, social-media advertisements or people presenting themselves as investment professionals. They may be directed to a trading application showing apparently successful investments and increasing profits.

When the victim attempts to withdraw the displayed amount, additional money may be demanded for tax, security deposit, account activation or withdrawal charges. The balance displayed on a fraudulent application may not represent a genuine investment.

Part-Time Job and Task Scams

A person may be offered money for reviewing hotels, liking videos, rating businesses or completing other online tasks. Small payments may initially be made to create confidence. Later, the victim may be asked to deposit larger amounts for premium tasks, merchant orders or recharge activities.

UPI, OTP and Phishing Fraud

Cybercriminals may attempt to obtain banking credentials through fake customer-care numbers, phishing links, QR codes, fake KYC messages, screen-sharing applications or remote-access applications. Never disclose an OTP, UPI PIN, card CVV or banking password to an unknown person.

What Should You Do Immediately After Cyber Fraud?

Time is important in financial cybercrime. When money has been transferred to fraudsters, it may quickly move through multiple accounts.

1. Report Financial Cyber Fraud on 1930

The national cybercrime helpline 1930 should be contacted immediately in cases of financial cyber fraud. Early reporting can assist authorities and banks in tracing and potentially stopping movement of suspected fraud proceeds.

2. File a Complaint on the National Cyber Crime Reporting Portal

A complaint can also be filed through the Government of India’s National Cyber Crime Reporting Portal: www.cybercrime.gov.in. Preserve the complaint acknowledgement number for future follow-up.

3. Inform the Bank

Inform the bank immediately and provide transaction details, UTR/reference number, date and time, amount transferred, beneficiary details, UPI ID, screenshots and the cybercrime complaint number.

4. Preserve Digital Evidence

Do not delete WhatsApp conversations, Telegram chats, SMS messages, emails, screenshots, call records, bank statements, payment receipts, UPI IDs, QR codes, website links, mobile numbers or social-media profiles connected with the fraud.

What Happens When a Bank Account Is Frozen?

When stolen money moves through multiple accounts, investigators may follow the money trail to identify accounts that received or transferred suspected fraud proceeds. This can result in a bank account being subjected to a lien, debit restriction or freeze.

The fact that suspected cybercrime money entered an account does not by itself establish that the account holder committed the fraud. The circumstances surrounding the transaction have to be examined.

What If Your Account Is Frozen Despite a Genuine Transaction?

A legitimate businessman, professional, employee, trader, seller or service provider may receive money through an ordinary commercial transaction and later discover that the account has become connected to a cybercrime investigation.

Depending on the facts, an affected account holder may need to obtain information about the complaint or FIR, identify the investigating agency, understand the nature of the bank restriction, identify the disputed transaction, collect documents showing the legitimate source and purpose of the transaction, cooperate with the investigation and seek appropriate legal remedies where required.

What Is a Mule Bank Account?

A mule account generally refers to a bank account used to receive, transfer or route proceeds connected with fraud. Some individuals may knowingly allow accounts to be used for commissions, while others may claim their accounts were used without understanding the ultimate purpose.

Investigators may examine source of funds, transaction patterns, withdrawals, communications, KYC records, digital evidence, account-holder conduct and whether any financial benefit was received.

Can Money Lost in Cyber Fraud Be Recovered?

Recovery may be possible in appropriate circumstances, particularly when fraud is reported quickly and the money has not yet been withdrawn or transferred through multiple layers. Recovery cannot be guaranteed. Cybercriminals may rapidly move funds through several accounts or convert money into cash, cryptocurrency or other assets.

What If the Cybercrime Complaint Gets No Immediate Response?

Filing an online complaint should not necessarily be treated as the end of the process. Depending on the circumstances, a complainant may follow up using the acknowledgement number, approach the concerned cyber police station, submit additional evidence, approach senior police authorities or seek appropriate remedies before a competent court.

How Can People Protect Themselves From Cyber Fraud?

Never transfer money because someone threatens you with arrest over a telephone or video call. Never share an OTP, UPI PIN, CVV or banking password. Do not install unknown APK files or applications sent by strangers. Do not give unknown persons remote access to your mobile phone or computer. Do not assume that profits displayed on an investment application are genuine. Be cautious before joining unsolicited WhatsApp or Telegram investment groups. Do not pay additional “tax”, “verification” or “withdrawal” charges merely to release supposed profits. Verify UPI IDs and bank details before making high-value transactions.

Cybercrime Is Also a Legal Awareness Issue

Cybercrime is not simply a technology problem. It can involve criminal law, banking procedures, digital evidence, investigation, financial transactions and procedural remedies. For victims, the first few hours following a fraudulent transaction can be particularly important. For genuine account holders affected by a freeze or lien, the challenge can be different: demonstrating the legitimate source and purpose of the transaction while cooperating with the investigation and pursuing appropriate remedies where necessary.

Legal Perspective: Adv. Javed Pashu Sayyed

This public-awareness discussion is based in part on legal-awareness material authored by Adv. Javed Pashu Sayyed, whose practice includes criminal law, cybercrime-related matters, arbitration and constitutional and related legal proceedings. His professional profile records experience across criminal law, arbitration, civil litigation, corporate and commercial disputes and cybercrime, along with appearances before the Supreme Court of India, Bombay High Court, Sessions Courts, Magistrate Courts and other forums.

Conclusion

The nature of cybercrime continues to evolve, but speed, evidence and awareness matter. A person who has lost money should report the fraud as quickly as possible rather than waiting to determine whether the money will return on its own. A person whose bank account has been frozen should also understand that the existence of a cybercrime complaint does not by itself answer every question about the account holder’s involvement. The transaction, source of funds, available evidence and applicable legal procedure must be examined.
