MUMBAI (India CSR): In an incident that has sent shockwaves through the financial and entertainment sectors of India, the Raigad police have charged five individuals, including Rashesh Shah, the Chairman of the prestigious Edelweiss Group, with abetment of the suicide of art director Nitin Desai.

This tragic incident raises urgent questions about mental health, corporate responsibility, and the dark side of success in modern society.

  • Nitin Desai had taken loans of Rs 252 crore from ECL Finance, a subsidiary of Edelweiss Group, for his company ND’s Art World Pvt Ltd, which runs a studio in Karjat, Raigad district.
  • He had defaulted on the loan repayments and his company was facing insolvency proceedings initiated by the National Company Law Tribunal (NCLT) on July 25, 2023.
  • He allegedly hanged himself at his studio on August 2, 2023, leaving behind an audio suicide note on his phone, naming four people who were allegedly responsible for his death.
  • His wife Neha Desai filed a complaint with the Khalapur police station, alleging that her husband was harassed and threatened by the officials of Edelweiss Group and Edelweiss Asset Reconstruction Company (EARC) for loan recovery.
  • The police registered an FIR under IPC sections 306 (abetment of suicide) and 34 (common intention) against Rashesh Shah, Smit Shah, Keur Mehta, R K Bansal, and Jitender Kothari on August 5, 2023.
  • The police have also sent Nitin Desai’s phone to the forensic department for analysis and have asked the accused to join the probe.
  • Edelweiss Group has denied any wrongdoing and has issued a statement saying that no undue pressure was exerted on Nitin Desai for loan recovery and that they are cooperating with the authorities.

The Nitin Desai Loan case concerns the death of renowned Bollywood art director, Nitin Desai, found dead in his Karjat studio on August 2, 2023. He is suspected to have died by suicide, attributed to financial stress and debt.

Loan Details: The Financial Struggles

According to the news reports, Nitin Desai had taken a loan of Rs 180 crore from ECL Finance Limited (ECLFL) in 2016 and another loan of Rs 31 crore in 2018. He had also mortgaged his land and properties as security for the loans. However, he failed to repay the loans on time and his account was classified as NPA (non-performing asset) on March 31, 2021.

Debt Assignment and Legal Proceedings

The ECLFL had assigned the debt to Edelweiss Asset Reconstruction Company Limited (EARC) in 2020, which filed a petition against Nitin Desai’s company ND’s Art World Private Limited for unresolved debt totalling Rs 252.48 crore. The National Company Law Tribunal (NCLT), Mumbai bench ordered the initiation of Corporate Insolvency Resolution Process (CIRP) against Nitin Desai’s company on July 25, 2023.

Allegations and Criminal Case

Nitin Desai’s wife Neha Desai has alleged that her husband was harassed by the officials of EARC to repay the loans and that they had threatened to take over his studio and properties. She has filed a complaint of abetment to suicide against five persons, including Edelweiss Group chairman Rashesh Shah, and the Raigad police have registered a criminal case against them.

Recovery of Evidence: The Suicide Note

The police have also recovered Nitin Desai’s mobile phone, which contained an audio suicide note naming four people who were allegedly responsible for his death. The phone has been sent to the forensic department for analysis.

This film was a romantic drama based on the 1917 novel of the same name by Sarat Chandra Chattopadhyay. The story follows the tragic love triangle between Devdas, a wealthy young man, Paro, his childhood sweetheart, and Chandramukhi, a courtesan. Nitin Desai recreated the lavish and opulent sets of the early 20th century Bengal, including the mansions of Devdas and Paro, the brothel of Chandramukhi, and the train station where Devdas dies.
