Bribery Case: Pension and Gratuity Withhold of a Retired ASO in Odisha

The permanent withholding of Renuka Devi's pension and gratuity following her conviction in a bribery case underscores the serious repercussions of corrupt practices in public service.

Introduction

The pension and gratuity of Renuka Devi, a retired Assistant Section Officer (ASO) from the Board of Revenue, Odisha, Cuttack, were permanently withheld following her conviction in a bribery case. This case highlights the consequences of corruption and the stringent measures taken to ensure accountability among public servants.

Background

Renuka Devi, an Ex-ASO, was charged with demanding and accepting a bribe for issuing a registration certificate for a Private Hospital Association. The Odisha Vigilance department filed charges against her under the Prevention of Corruption (PC) Act, 1988. The case was registered under sections 13(2) read with 13(1)(d) and 7 of the PC Act, 1988.

The Bribery Incident

Renuka Devi was accused of demanding a bribe from a complainant for the issuance of a registration certificate. The complainant, aggrieved by the demand, approached the Odisha Vigilance. A trap was laid, and Renuka Devi was caught red-handed while accepting the bribe. The evidence collected during the investigation led to her being charge-sheeted and subsequently convicted.

Legal Proceedings and Conviction

The case was presented in the Special Judge, Vigilance, Cuttack court. After a thorough examination of the evidence and testimonies, the court found Renuka Devi guilty of the charges. She was sentenced to two years of rigorous imprisonment and fined Rs. 10,000. In default of payment, she would have to undergo an additional six months of rigorous imprisonment.

Administrative Actions Post-Conviction

Following her conviction, the Odisha Vigilance communicated with the competent authority to take appropriate action against Renuka Devi. As per Rule 7(1) of the Odisha Civil Services (Pension) Rules, 1992, the competent authority decided to withhold her full pension and gratuity permanently. This decision was effective from May 16, 2024.

The withholding of pension and gratuity had a significant impact on Renuka Devi. As a retired public servant, she was entitled to these benefits for her post-retirement sustenance. The permanent withholding meant a complete loss of financial security that she would have otherwise relied upon.

It underscores the importance of maintaining integrity and accountability in public service. The stringent measures taken against Renuka Devi highlight the commitment of the authorities to uphold the law and ensure justice.

The case was prosecuted under the PC Act, 1988, which aims to combat corruption among public servants. Sections 13(2) and 13(1)(d) deal with criminal misconduct by public servants, while Section 7 pertains to public servants taking gratification other than legal remuneration. The Odisha Civil Services (Pension) Rules, 1992, provide the framework for withholding pension and gratuity in cases of proven misconduct.
