Court Decision on PepsiCo’s Potato Variety FL-2027 Sparks New Conversations on Plant Variety Rights and Public Interest


Court Ruling Challenges PepsiCo’s Plant Variety Rights

In a striking development in the realm of plant variety rights, India’s Delhi High Court’s recent decision has challenged multinational giant PepsiCo. The Hon’ble Court upheld the revocation of registration for PepsiCo’s potato variety FL-2027, with the judgment passed on 5th July 2023. While PepsiCo has suffered a setback with this ruling, it’s noteworthy that the Court rejected the argument of ‘public interest‘ invoked by the Plant Variety Protection and Farmers‘ Rights Authority (PPVFR Authority).

PepsiCo India’s Official Statement

PepsiCo India shared an official statement in light of these recent events. A spokesperson for the company stated, “We had filed an Appeal against the order of revocation of registration of our potato variety FL-2027. The Appeal was filed on several grounds and the Hon’ble Delhi High Court vide its order dated 5th July 2023 upheld the revocation primarily on procedural infirmities in the application and other supporting documents.”

Court’s View on ‘Public Interest’ Argument

Although the judgement wasn’t entirely in favour of PepsiCo, the Court concluded that the company’s exercising of rights, granted via the registration of its potato variety under the Plant Protection Variety and Farmers Rights Act (PPVFRA), cannot be considered against public interest. The Court declared the revocation of registration by the PPVFR Authority on the ground of ‘public interest’ as erroneous.

PepsiCo India Plans to Review the Judgement

The spokesperson further added, “We are in the process of examining the order in detail to decide our options.”

The Broader Implications of the Judgement

This decision has put a spotlight on the complex intersection of corporate interests, agricultural practices, and legal frameworks. It raises critical questions about the management of plant variety rights, corporate responsibilities, and the role of ‘public interest’ in such debates.

Changing Discourse around Plant Variety Protection

Though the revocation of registration has been upheld, the dismissal of the ‘public interest’ argument by the Court significantly impacts the discourse around plant variety protection. It brings forth a nuanced perspective on the rights granted under the PPVFRA and their interpretation in favour or against the public interest.

The Future of PepsiCo’s Legal Journey in India

With the Court’s ruling, PepsiCo finds itself in an intriguing situation. As the company examines the order in detail and decides its next steps, stakeholders eagerly await the unfolding of this event, which might reshape the discussions on plant variety rights and public interest in India.
