The Social Media Giant’s Approach to Censorship Sparks Debate on Public Safety Versus Freedom of Speech

NEW DELHI (India CSR Exclusive): In Meta’s recently published 2023 Responsibility Report, a key focus is a contentious case involving a disturbing Instagram video. The post, originally removed for violating Meta’s Adult Sexual Exploitation policy, was later reinstated due to its perceived newsworthiness. This incident, revolving around a video of a woman being harassed in India, provides a revealing look into the complexities of social media content moderation.

Meta’s recently released 2023 Responsible Business Practices Report offers a deep dive into the social media giant’s decisions on content moderation. A case highlighted in the report involves a controversial decision to leave up a distressing video depicting a woman being harassed by a group of men in India.

Details of the Controversial Case

The report outlines an incident where a video depicting the harassment of a woman in India was posted on Instagram. The post, shared by an account claiming to share “stories from a Dalit’s desk,” described the victim as a tribal woman. It initially violated Meta’s Adult Sexual Exploitation policy, resulting in the removal of the content. However, upon further review, Meta deemed the post newsworthy and reinstated it, with a warning screen, for users over 18.

Balancing Act: Public Safety Versus Freedom of Speech

This decision sparked a debate about Meta’s approach to content moderation, highlighting the tension between its stated values of safety and voice. As Meta wrestled with allowing content that condemns sexual exploitation versus content that might harm by depicting sexual harassment, it turned to its Oversight Board for guidance.

“Striking the appropriate balance between allowing content that condemns sexual exploitation and content that has the potential to harm is a significant challenge,” the report states. “We referred this case to the Oversight Board because it presented a tension between our values of safety and voice.”, the report said.

The Oversight Board’s Ruling

In response, the Oversight Board upheld Meta’s decision to restore the post, with a few stipulations. The board asked Meta to clarify the relevant guidance to content reviewers and to introduce an exception to its Adult Sexual Exploitation policy for instances in which people seek to draw attention to issues of public importance.
