CHENNAI: It has been reported that the Madras High Court has been moved by a petition seeking a comprehensive, time-bound inquiry into allegations that Sridhar Vembu, founder of Zoho Corporation, diverted corporate funds to finance BJP candidates across 27 Assembly constituencies in the upcoming elections.
The petition, filed by Advocate P Sundara Vadivelu, a resident of Perungudi, calls for a multi-agency investigation involving:
- The Election Commission of India (ECI)
- The Income Tax (IT) Department
- The Central Board for Direct Taxes (CBDT)
- The Enforcement Directorate (ED)
Allegations of Financial Irregularity
According to the petitioner, funds from Zoho’s corporate accounts were allegedly utilized for purposes entirely “unconnected with the legitimate business activities of the company.” Vadivelu argued that such a diversion of capital raises critical questions regarding financial propriety, tax law compliance, and established standards of corporate governance.
“Any deviation in this regard would have serious legal and regulatory implications,” the petitioner stated, emphasizing that corporate resources should not be leveraged for partisan political maneuvering.
Impact on Electoral Integrity
The petition specifically highlights that these funds were allegedly directed toward candidates in the 27 constituencies where the BJP is contesting, including the Vasudevanallur (Reserved) seat.
The legal crux of the argument rests on the Representation of People Act, 1951. Vadivelu contends that if these transactions are found to have influenced the electoral process, they would constitute a “corrupt practice” under Section 123 of the Act.
Official Representation Filed
In addition to the court plea, the petitioner has formally submitted a representation to the Chief Electoral Officer, Archana Patnaik, demanding an immediate investigation to ensure a level playing field.
The Madras High Court is expected to hear the matter shortly, as the allegations strike at the intersection of corporate accountability and the transparency of election funding.
