The Supreme Court of India has issued its verdict on the legal challenges to the 2016 demonetization of currency notes, with Justices BR Gavai and BV Nagarathna announcing separate judgments.

1. Introduction

The Supreme Court of India has ruled on the legal challenges to the 2016 demonetization of currency notes, with Justices BR Gavai and BV Nagarathna issuing separate judgments. The decision has sparked reactions from the government, the Reserve Bank of India, and the petitioners, and has implications for the demonetization controversy and the Indian economy.

The Supreme Court of India announced its verdict on the legal challenges to the 2016 demonetization of currency notes, which involved the discontinuation of Rs 1,000 and Rs 500 denominations. A batch of 58 petitions were heard by the court, and separate judgments were to be pronounced by Justices BR Gavai and BV Nagarathna.

2. Arguments Made in Court

During the hearing, the Attorney General, the Reserve Bank of India (RBI), and the petitioners’ lawyers presented their arguments. The government defended the demonetization as a necessary measure to combat issues such as fake money and tax evasion, while the RBI acknowledged the existence of “temporary hardships” but believed there were mechanisms in place to address them. The petitioners argued that the government did not have the power to initiate proposals relating to legal tender and that the demonetization was deeply flawed.

3. The Supreme Court’s Verdict

The Supreme Court upheld the demonetization in its verdict, with Justice Gavai announcing his decision. However, there were differences in opinion between Justices Gavai and Nagarathna on the powers of the central government under the RBI Act. It is not clear whether the judgments were concurring or dissenting.

4. Reaction to the Verdict

The verdict was met with reactions from the government, the RBI, and the petitioners, including any statements or responses made. The implications of the decision and any potential future actions were discussed.

5. Conclusion

The main points of the case and the verdict were summarized, and a final analysis or opinion was provided on the impact of the decision on the demonetization controversy and the Indian economy.
